Q: Why is the Schedule of Services now sold separately?

A: ACE has taken the decision to sell the Schedule of Services separately as it allows multiple schedules for work in various disciplines to be attached to one main Agreement. It also lets users attach their own bespoke schedules (and any other attachments) to the main Agreement.


Q: ACE used to sell a Planning Supervisor (now known as CDM coordinators) Agreement - is one included in the new suite?

A: No, a separate CDM co-ordinator agreement is no longer necessary.  ACE Agreement 2 is intended to fulfil such a role.  A space has been left in Part F of Agreement 2 for a CDM co-ordinator to describe the particular services being provided.


Q: Why has ACE discontinued the Short Form Agreement?

A: The new Agreement 2 fulfils the role of the old Short Form, i.e. providing services of all types, except where the consultant’s client intends to engage a contractor to construct permanent works designed by the consultant.  In this latter instance, Agreement 1 should be used.


Q: Can I still use the ACE Agreements 2002 (revised 2004) or are they now obsolete?

A: Yes you can still use the ACE Agreements 2002 (revised 2004) and in terms of legal content they are still good law however they will no longer be available for sale as from 6 May 2009.
